Last Tuesday early morning, a sea lion walked from the beach into Pantai Inn in La Jolla, California. The animal was rescued by local animal rescue authorities. Wikinews took an interview from Shane Pappas, a General Manager of the inn.

((Wikinews)) At what time of day did the sea lion enter the Inn?

Shane Pappas: Surveillance footage shows that our sea lion friend made her way onto our property at approximately 5:45am on Tuesday morning. She waddled through our courtyard and climbed up onto one of our lounge chairs.

((WN)) How long did he stay in the Inn before he was moved out of the building?

Shane Pappas: The sea lion was not seen by our staff until about 6:30am. At that point my front desk agent Veronica made frantic calls to the authorities to find someone to come rescue the sea lion. By the time we got a hold of Sea World they were able to come and rescue her at around 9:45am. All told the sea lion was here for about four hours.

((WN)) What do you think attracted the animal? Was it the radio sound? Was it heard as far as the beach?

Shane Pappas: We’re not sure what attracted the sea lion. We like to think that it was the beauty and relaxation of our courtyard. In regards to the radio sound I’m not sure what you are referring to.

((WN)) Who and how transported the animal out of the building?

Shane Pappas: A gentleman named Bill who is a rescue worker with Sea World came out to rescue the pup. He asked if I would assist in the rescue which I was more than happy to do. It’s not every day that you get to rescue a sea lion.

((WN)) Where was the animal transported to?

Shane Pappas: The sea lion was loaded into a crate on a truck and transported back to Sea World. She will be kept there for six weeks so that she can be nursed back to health and returned to the wild.

Report reveals Top 10 most-confusing tech buzzwords

Danville, California — The California-based Engligh language tracker, Global Language Monitor, released its 2005 list of most confusing – yet frequently cited – high tech buzzwords to be “HTTP,” “Voice Over IP” (VoIP), and “Megapixel.” Closely following were “Plasma,” “Robust,” “WORM” and “Emoticon.”

In early March, the group used a predictive index computer algorithm to track specific words and phrases in the media and on the Internet. They were tracked in relation to frequency, contextual usage and appearance in global media outlets.

The Global Language Monitor claims to analyze and catalogue trends in word usage and word choices, focusing on the linguistic impact on various cultures. The GLM says it relies upon a global network of volunteer linguists, professional wordsmiths and other bibliophiles to monitor the trends in the evolution and demise of world languages.

GLM’s list, in order of frequency of use, of the most-confusing technology terms with the group’s explanation as to why they are faulty follows:

  1. HTTP – HyperText Transfer Protocol is the standard protocol used for transmitting web pages (which are written in HTML (HyperText Markup Language)), not text written while hyper on too much Starbucks coffee. There are more than 1 billion references to HTTP on the web alone.
  2. Voice over IP – Voice over Internet Protocol, (pronounced voyp, similar to Detroit) is a way of transmitting voice data over the Internet. VoIP is becoming more popular as services such as Skype offer people free voice communication with anyone with a broad-band connection.
  3. Megapixel – Approximately one million pixels, not a single, big pixel (“mega” is the metric system prefix for million). “Pixel” itself is a technical term which means “picture element”. Digital pictures consist of a grid of millions of pixels, which are square or rectangular dots, each having a single colour.
  4. Plasma – A plasma display (commonly used in televisions) is a flat, lightweight surface with a grid of millions of tiny glass bubbles containing plasma. A digitally controlled electric current flows through the bubbles causing the plasma inside to glow various colours. Plasma displays have nothing to do with blood plasma.
  5. Robust – Robustness generally means “it won’t break easily.” It supposedly describes computer programs or hardware that have been well-tested and demonstrated to not crash or fail often, but since it is a vague term by nature (how robust is robust?) it is frequently used by marketing types regardless.
  6. WORM – While a worm is a type of computer virus, WORM stands for ’Write Once, Read Many’. It describes a file system primarily used for optical disks, such as CDs and DVDs. For example, CD-Rs can only be written (or “burned”) once but afterwards can be read many times (otherwise you could only listen to your music CD once). This excludes re-writable CDs which can be written many times.
  7. Emoticon – Emoticon stands for emotional icon. An emoticon is a sequence of characters that look visually like a face and are used in text chat to convey emotion. The most common emoticon is the smiley face – 🙂 – which looks like two eyes and a mouth turned 90 degrees.
  8. Best of Breed – Not to be confused with the Westminster Dog Show, a best-of-breed product is a personalized solution made of components from various manufacturers; in other words, it’s a sort of high tech ‘mix-and-match’.
  9. Viral Marketing – A recent marketing trend which relies on word-of-mouth to spread, rather than traditional advertising strategies. It is called “viral” because as people talk about it, the marketing message “spreads” to new people, who in turn inform others, and so on, which is how viruses spread. The Burger King “Subservient Chicken” campaign is considered an example of viral marketing. Computer viruses used by spammers to turn desktop computers into “zombie” spam relays are something completely different.
  10. Data Migration – Data migration is an idealistic (though usually impossible) concept where data can be used by different versions of the program in which it was created (newer or older). The migration (migration means “to move”) refers to the fact that the data is moved from one version (or program) to another without difficulty or loss of information. It is a subset of backward and forward compatibility.

Other terms being tracked included “client/server,” “solution,” “paradigm,” “backward compatible,” and the “STUN protocol.”

An example of an essential car fluid is your fuel. If there is no fuel, your car would not even run or go a certain small distance.

The very thing about car fluids is that they do not get used up, with the exception, of course, of fuel. Fuel is the only car fluid that is used up. As per the other fluids which comprise of oil, coolant, windshield washer fluid, brake fluid, power steering fluid, gear oil, and automatic transmission fluid, all of these remain in their containers. Now, according to automobile experts, if you do notice that there is a low level or amount of the various fluids in your car, it may be an indication of a leak.

Oftentimes, leaks are easily detected and there is no need for you to rush to a car service shop or garage just to see if there is indeed a leak going on. Anyhow, you should first open the hood of your car and inspect the engine and the engine compartment. You should also go underneath your car and see if there are areas that are wet or if there are some places dripping. While doing this, you should use a flashlight to help you out.

To help you out know which fluids are leaking, you could use the following information: Coolant looks green and sticky. If it is the windshield wiper fluid that is leaking, you would find this to be bluish and kind of watery. Your cars engine oil would seem to be honey-colored or dark-colored and it is greasy. As per the automatic transmission fluid or the power steering fluid, it would be slippery and reddish. The brake fluid would look clear or even yellowish at times.

New fossils from 10 million year old ape found in Ethiopia

Researchers say that new, ten million-year-old fossils found in Ethiopia, prove that the theory that humans may have evolved from a species of great apes eight million years ago, may not be true, but that humans may have split from apes as long as 10.5 million years ago.

At least nine fossilized teeth, one canine tooth and eight molars, of a previously unknown species of apes found in Africa were discovered by a team of researchers from Ethiopia and Japan who then compared the 3-D make up of the teeth to other fossils that date back as far as 8 million years and found that the fossils are likely a “direct ancestor” of apes currently living in Africa and that the new ape fossils were that of a species of gorilla who ate mostly plants high in fiber.

Current fossils and research say that the evolutionary split from apes to humans occurred at least eight million years ago. The new fossils say that the split may have happened as long as 10.5 million years ago.

“Based on this fossil, that means the split is much earlier than has been anticipated by the molecular evidence. That means everything has to be put back,” said researcher at the Rift Valley Research Service in Ethiopia and a co-author of the study, Berhane Asfaw.

Despite the finds, other researchers are not convinced that the findings are correct.

“It is stretching the evidence to base a time scale for the evolution of the great apes on this new fossil. These structures appear on at least three independent lineages of apes, including gorillas, and they could relate to a dietary shift rather than indicating a new genetic trait,” said a Professor at the London Natural History Museum in the United Kingdom, Peter Andrews who also added, “but the fossil evidence for the evolution of our closest living relatives, the great apes, is almost non-existent.

Researchers have named the newly discovered species Cororapithecus abyssinicus whose remains were found in the Afar Region of Ethiopia, the same place where the remains of Lucy were discovered in 1974.

United States begins testing equipment for demolition of a major VX nerve gas stockpile

Testing began on a chemical reactor at the Newport Chemical Depot near Terre Haute, Indiana on Friday morning. If successful, the reactor will be put to use destroying the large VX nerve gas stockpiles stored at the facility over the course of the next two years. After the disposal project experienced several delays, the facility announced it would begin pumping VX into a completed disposal unit for testing. The unit consists of a chemical reactor in which the VX will be mixed with water and sodium hydroxide, heated to 194°F while mixed with paddles. The resulting chemical, called hydrolysate, is chemically similar to commercial drain cleaners and has similar properties. If the test is successfully completed , the unit will continue processing the VX until the entire stockpile has been neutralized, a process projected to take two years. Administrators expect to complete testing on May 10, 2005.

According to the controversial plan, the finished waste product would be shipped to New Jersey for final reprocessing. The inert chemical would then be emptied into the Delaware River where natural attenuation would occur.

Residents near the proposed river disposal site in New Jersey oppose this idea. The contractor for the final component of this disposal would be the DuPont Corporation.

NCD is a bulk chemical storage and destruction facility in west central Indiana, thirty miles north of Terre Haute. Originally founded during World War II to produce RDX, a conventional explosive, it later became a site for chemical weapons manufacturing during the Cold War. It is now used to securely store and gradually neutralize part of the US stockpile of VX.

VX was manufactured by the U.S. in the 1950s and 60’s as a deterrent to possible Soviet Union use. It was never deployed, and the manufacture was halted in 1969 after an order signed by then-president Richard Nixon.

In 1999, the Army announced it awarded a disposal contract to Parsons Infrastructure & Technology, Inc., a business unit of Parsons Corporation. Some 220 civilian Parsons employees work at the facility, which is supervised by an Army officer reporting to the U.S. Army Chemical Materials Agency, and a board of civilian government overseers called the Indiana Citizens’ Advisory Commission, some of whose members are appointed by the state governor.

Security at the facility is controversial. A private security service, supplemented by a complement of Indiana National Guard soldiers, guarded the facility until April 14, 2005, when the soldiers were withdrawn. An Indianapolis television station has questioned security measures in some of its special reports.

Tornado kills one and injures 100 in northern Colorado

A tornado that has caused 28 miles (45 km) of destruction throughout Weld County, Colorado, has killed one and injured 100. The man killed was inside a vehicle that was destroyed in the storm, west of Greeley, which is about 60 miles (97 km) north of Denver.

A state trooper says that multiple car accidents occurred on highways throughout the county. U.S. Route 85 was closed after two semi-trailers were flipped over, though the drivers were not injured. Dozens of houses and vehicles were badly damaged by the tornado as it passed through. The town of Windsor had hundreds of homes and businesses damaged, including the town hall, in addition to trees down and electricity outages. In response to the disaster, Colorado Governor Bill Ritter declared a state of emergency and activated the Colorado National Guard in the badly damaged Weld County.

Severe storms also hit Laramie, Wyoming, 145 miles northwest of Denver, knocking out electricity to 7,300 customers and damaging buildings. One damaged building, the Quadra Dangle Square Dance Club, listed on the National Register of Historic Places, had its roof and porch ripped off. The Associated Press reports Brian Chapman of the National Weather Service in Cheyenne as saying that “indicators are very strongly in favor of it being a tornado,” but no confirmation is possible until the damage is fully assessed. Governor Dave Freudenthal of Wyoming has also authorized a crew of eight National Guardsman to help clean up the damage. Another twister touched down just east of Cheyenne, Wyoming. The local fire department responded to a call after the storm damaged a barn and a house just south of I-80.

Rain, hail and snow pelted the entire region, and more storms are predicted for today. The National Weather Service in Cheyenne reports, “Severe thunderstorms are likely again this afternoon into early this evening mainly east of the Laramie Range…with the greatest threat east of Cheyenne across the southern Nebraska panhandle. Locally heavy rainfall is also possible which may cause some localized flooding especially in areas that received heavy rainfall Thursday.” Winds are expected to gust above 40mph throughout the day. Surgeons reattach boy’s three severed limbs

Tuesday, March 29, 2005A team of Australian surgeons yesterday reattached both hands and one foot to 10-year-old Perth boy, Terry Vo, after a brick wall which collapsed during a game of basketball fell on him, severing the limbs. The wall gave way while Terry performed a slam-dunk, during a game at a friend’s birthday party.

The boy was today awake and smiling, still in some pain but in good spirits and expected to make a full recovery, according to plastic surgeon, Mr Robert Love.

“What we have is parts that are very much alive so the reattached limbs are certainly pink, well perfused and are indeed moving,” Mr Love told reporters today.

“The fact that he is moving his fingers, and of course when he wakes up he will move both fingers and toes, is not a surprise,” Mr Love had said yesterday.

“The question is more the sensory return that he will get in the hand itself and the fine movements he will have in the fingers and the toes, and that will come with time, hopefully. We will assess that over the next 18 months to two years.

“I’m sure that he’ll enjoy a game of basketball in the future.”

The weight and force of the collapse, and the sharp brick edges, resulted in the three limbs being cut through about 7cm above the wrists and ankle.

Terry’s father Tan said of his only child, the injuries were terrible, “I was scared to look at him, a horrible thing.”

The hands and foot were placed in an ice-filled Esky and rushed to hospital with the boy, where three teams of medical experts were assembled, and he was given a blood transfusion after experiencing massive blood loss. Eight hours of complex micro-surgery on Saturday night were followed by a further two hours of skin grafts yesterday.

“What he will lose because it was such a large zone of traumatised skin and muscle and so on, he will lose some of the skin so he’ll certainly require lots of further surgery regardless of whether the skin survives,” said Mr Love said today.

The boy was kept unconscious under anaesthetic between the two procedures. In an interview yesterday, Mr Love explained why:

“He could have actually been woken up the next day. Because we were intending to take him back to theatre for a second look, to look at the traumatised skin flaps, to close more of his wounds and to do split skin grafting, it was felt the best thing to do would be to keep him stable and to keep him anaesthetised.”

Professor Wayne Morrison, director of the respected Bernard O’Brien Institute of Microsurgery and head of plastic and hand surgery at Melbourne’s St Vincent’s Hospital, said he believed the operation to be a world first.

Former South Korean President dead after apparent suicide

Former South Korean President Roh Moo-Hyun died after falling from the side of a mountain near his house in an apparent suicide, the state-run Yonhap News Agency reported early Saturday.

Roh, who was facing an investigation into allegations of bribery, fell at about 6:30 a.m. Korea Standard Time (9:00 p.m. GMT), after having gone hiking with an aide. Roh was taken to the Pusan National University Hospital, where he died at 9:30 a.m.

“Roh left his home at 5:45 a.m. to go hiking,” Moon Jae-in, an adviser to Roh, said. “He appears to have jumped from a mountain rock at 6:40 a.m. He was accompanied by a bodyguard at that time.”

“He left behind a brief suicide note,” Moon added.

The investigation stems from allegations that Roh received a US$6 million bribe while in office.

Pusan National University Hospital chief Paek Seung-wan told reporters that Roh died of a head injury.

“At the time of his arrival at the hospital at 8:23 a.m.,” Paek said, “he was unconscious and couldn’t breathe on his own. A laceration measuring 11 centimeters was found on the front part of his head. Doctors attempted cardiopulmonary resuscitation but suspended it at 8:30 a.m. as he failed to recover. A brain contusion was also found, but head injury was confirmed as the direct cause of his death. In addition, fractures were found, including in the ribs and pelvis.”

With some exceptions, most environmental policies are written on a claims-made and reported basis. Unlike occurrence forms, claims made forms require that the environmental claim must be received by the policyholder and reported to the company within the policy period or within an extended reporting period. To be continuously covered, the policyholder must continue to renew the coverage at the end of each term. Certain contractor policies may be written on either a claims-made or occurrence basis. Usually, the entire premium for environmental policies is due before coverage is initiated. According to Dan Persha, founder and director of Environmental Services Group (ESG), a division of Insurance Concepts, the market for environmental insurance is fluid and ever-changing. He added that the market is complicated in that there are no standard forms companies have their own forms. And theres no standard coverage, so its difficult to compare coverage from one company to the next. Persha said the main underwriters he uses are American International Group (AIG), ECS, Zurich Environmental and he uses them every day. Other underwriters, which Persha uses on a case-by-case basis, include Kemper, Gulf Travelers, Seneca and Chubb. Shawn Tate, regional underwriting manager for Zurich Environmentals South/Central region, agreed that the market is fluctuating, especially premiums. In some areas, the market is firming, in other areas its not theres not a lot of consistency in environmental right now, Tate said. We cant even guess on our competitors renewal prices for environmental lines because of fluctuations. During the past year Tates division wrote about $10.5 million in premiums. That figure was up about 20 percent over the previous year and the numbers represent a wide variety of policy types. The bulk of the policies were written in Texas and Louisiana. The division is expecting upward growth and increasing volumes. At least were targeting that, said Tate. Misunderstood Coverage Transaction insurance is one of the most misunderstood coverages, ESGs Persha said. But its a huge, emerging market because of growing environmental awareness and hazards buyers, sellers, and financial institutions are requiring it. Transaction insurance, environmental policies that provide coverage where property is changing hands, usually consists of pollutionlegal liability and cost cap coverage, Persha said. It is often used for transactions involving strip centers, due to the risk of dry cleaning solvent spills and damage from underground storage tanks (USTs). In fact, Persha said, although he sometimes writes policies for heavy commercial and Brownfields properties, 80 percent of the policies getting written are for strip centers withdry cleaners and USTs. Real estate transactions are driving the market no one will buy a property unless it has had a Phase One or Phase Two inspection, Persha said. And because of heavy inspections, they tend to find problems. According to Persha, term lengths for transaction insurance are almost always more one year; with three, five, seven and 10-year policies being common for a clean site one in which theres been no known problems. Although normally premiums run between $3,500 and $7,500 per year, some run less than that. And for a site with a known problem, or a buyer or seller that needs pollutionlegal liability and cost cap insurance the premiums can start around $50,000, Persha said. Persha said it is often difficult to find environmental insurance because of the risks. He is working on a case right now in Arizona where a client is buying a Nabisco distribution center a warehouse that is six months old and has never had any spills its a clean site. Within a mile of the facility, there is a Superfund site that has the potential to impact the warehouse in the future, so the client is buying a policy to cover any future problems, such as diminution of value, loss of rent, and business interruption. Thats how cautious the market is I contacted four companies for coverage two declined, two will quote, Persha said. An Opportunity Steve Morton, an attorney with the Austin-based firm of Jenkens & Gilchrist, represents clients in negotiations with insurance companies over terms and conditions of insurance policies and contracts in real estate transactions. He has handled policies for clients ranging from ranch owners to large corporations and has seen premiums running from $35,000 for a three-year contract to $500,000 for a 10-year policy. Coverage levels range from $1 million to $50 million. Often, Morton said, a corporation that owns a portfolio of properties, such as shopping centers, may purchase pollution liability insurance to cover spills on the properties. Typically, Morton said, all the properties in the ownership portfolio are covered by one policy, and the more properties, the lower the premium costs. Morton noted that agents might want to consider pollution liability as an opportunity, and one particular area they might want to look at is lending institutions-banks. Banks that lend money on commercial properties dont want to be caught if pollution is found on a property they lend on, said Morton, so they may require buyers to provideenvironmental insurance that names the bank as one of the insureds. A Hot Ticket According to Sheila Hailey, dry cleaners pollution polices are a hot ticket right now. Although she also writes pollution coverage for USTs, Hailey said she gets an average of five calls per week for dry cleaning insurance and writes policies for 95 percent of those calls. Hailey added that the business is a flip-flop from previous years, in which she mostly wrote coverage for USTs. Hailey suggested that one reason for the increase in dry cleaners policies, is that in general, owners of strip malls in which dry cleaners are located are requiring cleaners to have pollution liability insurance. She said the average bill for cleaning a spill from a dry cleaners is $50,000 while the average cleanup from a gasoline station UST is $10,000. Limits for policies she writes generally start at $1 million per occurrence and $1 million per release, Hailey said. The average deductible fordry cleaners is $10,000 and average deductible for USTs is $5,000. For dry cleaners the average premium is $1,750. For new gas stations, premiums run from $300 to $500 per tank, and for some stations or owners with more than one station and multiple tanks, premiums can run up to the $20,000 range. Contractors, Consultants Becky Thompson, an associate vice president for property and casualty with Austin Surplus Lines, restricts the environmental policies she writes to those for consulting and engineering groups and contractors, such as remediation contractors that may be removing dirt from a site or working with lead and asbestos abatement programs. In order to ensure that there are no gaps, no in-fighting between carriers over whose responsibilities lie where, Thompson tries to combine pollution-related coverage with a contractor or consultant general liability policy. Thompson said that combining coverage is important not only to provide the client with the best and most complete coverage, it is also important from an E&O standpoint for the underwriter or agent. I have had agents say all they need is a general liability contract, but my feeling as a broker is thats leaving too many gaps, said Thompson. Mark Sowle, an MGA with EnStar Underwriters Inc. in Columbus, Ohio, agreed that it is often effective to write general liability, professional liability and pollution liability policies with the same carrier in order to prevent squabbling over coverage. However, Sowle said, the downside to combining the policies is that all the coverage would be tied to the same limits. Sowle, who writes contractor/consultant policies in Texas and other states, said his company generally insures small to mid-sized companies with revenues of about $5 million to $10 million annually. The minimum premium for general liability policies with pollution coverage he provides is $1,500 for a $1 million limit. Premiums and limits go up from there. It really depends on what the client needs, Sowle said, sometimes they need more insurance to get on a job site. A larger company may need higher limits theyll be buying contractor insurance with $10 million to $20 million limits. Jo Ann Taylor, with US Risk in Dallas, writes policies for consultants that have very little exposure, like rangeland consultants and archeologists that may never go out to a site, as well as for higher risk contractors who may be directly involved in cleanup and abatement projects. Taylor said many of her clients are companies with a mid-size risk, and the policies they require carry a $1 million limit. Deductibles and premiums run about $2,500, each. Taylor added that sometimes specific contracts or governmental agencies require a contractor to have in place a policy with higher limits. Taylor, Sowle and Thompson agreed that the devil is in the details when it comes to writing environmental policies that protect the client, the agent and the underwriter. The information included on an application is paramount, Sowle said. My duty as an MGA is to protect the companys assets, he said, adding that he must know exactly what the policy hes offering covers, as well as what the clients risks are. In addition, Sowle said he feels a responsibility to the producer that brings in the business, especially if they have never written environmental insurance. Environmental Risks Not only is Texas one of the largest states in terms of land mass (the largest, if you dont count Alaskas ice, as Texans like to say) it also ranks highest in the nation for on- and off-site releases of toxic materials?at least for releases by what the Texas Natural Resource Conservation Commission (TNRCC) calls original industries. These include traditionally heavily-polluting industries like oil and gas, and chemical refineries. However, plenty of non-environmental facilities and businesses have the need for pollution liability insurance that has increasingly become a necessity in todays environmentally conscious and litigious world. These businesses represent an opportunity and a challenge to agents and underwriters entering the niche market of environmental insurance. Types of Policies The largest players in the billion-dollar environmental insurance industry are AIG, ECS/XL, Kemper and Zurich. Other companies, such as United Coastal, Gulf Travelers, Seneca and Chubb, also offer pollution legal liability and related insurance. Sowle writes policies using Century Insurance Group, EnStars parent company. Generally, environmental policies offered by these companies fall into the following categories: Pollution Legal Liability: Insured are claims from unknown pollution conditions at covered locations specified in the policy. Generally, these policies cover both on- and off-site pollution conditions, and include claims for bodily injury, property damage and cleanup costs. Often, business interruption and transportation claims will be covered, but costs of an ongoing cleanup or existing, known contamination are not. Pollution legal liability policies are modifiable to fit individual circumstances and many terms and coverages are negotiable. Property Transfer: Similar to pollution legal liability policies, property transfer policies cover claims generating from a covered location for preexisting, unknown contamination and known contamination below reportable levels. In some cases it covers known contamination that may be at levels above regulatory limits but permitted by a governmental body and with a cap in place. Like pollution legal liability insurance, these policies cover bodily injury, property damage and cleanup costs. Limits, deductibles and exclusions are also similar to those found in pollution liability policies. Cleanup Cost Cap or Stop Loss: Very specific policies that protect against cost overruns for remediation of individual projects. Covered overruns may result from the discovery of additional amounts or newly discovered contaminants, or from changes in regulatory requirements at a site. Coverage is limited to cleanup costs, and claims for bodily injury; property damage or other liabilities are not covered. Also commonly excluded are the costs of legal defense and governmental negotiations. Other exclusions may include: radioactive matter, asbestos, contractual liability, unknown conditions not disclosed to the insurance company, and regulatory fines and penalties. Brownfields Restoration and Development: Cover properties with known contamination where remediation of pollution will take place as part of a development or restoration plan. They combine pollution legal liability and cost cap insurance and generally cover bodily injury, property damage, cleanup costs for unknown pollutants, and cost cap coverage for cleanup. Secured Creditor: Coverage is for the lesser of either 1.) the loan balance due with respect to property found to be contaminated or 2.) the cost to clean up the property. Coverage may be included for default on loans and third-party claims for bodily injury and property damage. However, unless specifically negotiated, the coverage will not apply to known contamination or in situations where the loan goes into default beyond the policy period. Professional and Contractor Environmental Liability: Covers environmental consultants and contractors, who may be exposed to third-party claims, as well as liability to the client in the event an error causes cleanup costs to exceed the estimate. Professional and contractor insurance programs often include contractor pollution legal liability and E&O insurance. Bodily injury and property damage claims are usually covered. Key exclusions include off-site waste liability, express warranties and guarantees, known claims or circumstances that existed before the coverage began, the cost to repair faulty workmanship and claims for the return of fees. Contractors are usually advised to keep these policies in place for a period of time after the work is completed. Transporter Insurance: Cover a transporter for off-site spills and liability for disposal of waste at a non-owned location. Coverage is included for oil, asphalt, sand and gravel, construction material, chemicals, and other toxic materials. Bodily injury, property damage and cleanup costs are covered, but known conditions, completed operations, and deliberate acts are commonly excluded. Storage Tank Pollution Liability: Covers releases from scheduled storage tank systems for corrective action on-site and off-site. Bodily injury and property damages are covered, and these policies can be used to meet Environmental Protection Agency and state financial responsibility requirements. Closure and Post Closure: Designed for regulated facilities with financial assurance obligations, these policies are an alternative to bonds, letters of credit, and trust funds. No liability or associated defense coverage is included. They are useful for solid waste landfills, hazardous waste treatment, storage and disposal facilities, and some manufacturing and materials processing sites. Finite Risk: Not traditional insurance coverage, this type of self-insurance policy is funded by the insured and administered by an insurance company.
